An uncontested divorce means both parties agree on all major issues — property division, custody, support — and the court simply approves the agreement. Arizona requires a minimum 60-day waiting period after the Petition is served before a divorce can be finalized. In practice, uncontested divorces may be resolved in a few months. Contested divorces can take significantly longer, depending on the complexity of the issues involved.
Arizona is a community property state, which means marital property is generally divided equitably. However, not all property will be deemed community property.
